Terms of sale
Last updated: 14 October 2026
These terms apply to buying original paintings and commissions on ampomata.com. Prints are bought from Fine Art America or Posterlounge, under their own terms.
1. Seller
Ángeles Martínez Pomata, Spanish national ID (DNI) 33519637-N, address: Cala Rajá, 1, 04118 Níjar (Almería, Spain). Contact: [email protected].
2. The paintings
Original paintings, one of a kind, signed by hand and sent with a certificate of authenticity. Each painting is sold only once. They are photographed carefully, but colours may vary slightly from screen to screen: you can ask for more photographs before buying. Paintings are sold unframed unless stated otherwise.
3. How to buy
Write to Angeles from the painting's page or by email. She confirms that it is still available, the total price including shipping and the payment method, and sends you a secure payment link or bank transfer details. The contract is made when you pay. Where a painting has a Buy now button, you can also buy it directly: choose the shipping destination, pay on Stripe’s secure page, and the contract is made when the payment is complete. You will receive confirmation of your purchase by email, together with these terms.
4. Reservations
A 30% deposit reserves a painting for two weeks. The deposit comes off the price. If you change your mind within that period, or the payment is not completed, the reservation ends and the deposit is refunded.
5. Price
Prices are final and in euros. For delivery within the European Union they include VAT. For delivery outside the European Union the sale is exempt from Spanish VAT; any import duties and taxes are set by the destination country's customs and paid by the buyer. Dollar prices are a guide only: payment is taken in euros. Shipping is charged separately and is shown on each painting.
6. Payment
By card, Bizum, Apple Pay or Google Pay (depending on your country), on Stripe’s secure page. PayPal and bank transfer are also accepted: ask Angeles and she will send you a payment request or the account details. We never see your card details. The painting ships once payment is complete. Instalments are not accepted unless expressly agreed.
7. Shipping and delivery
The painting is packed with protection and sent by tracked courier, signature on delivery, within 2 working days of payment. Delivery usually takes about 5 days within Spain, 7 to 8 days to the rest of Europe, 10 days to the United Kingdom and about 14 days to the United States; for other destinations we will tell you before you buy. In any case, delivery will take no more than 30 days.
The painting travels at the seller's risk until you receive it. If it arrives damaged, note it on receipt if possible, photograph the packaging and the painting and write to us within 48 hours: we will offer repair, another solution you accept, or a refund.
8. Right of withdrawal
If you buy as a consumer, you may withdraw from the purchase without giving any reason within 14 calendar days of the day you receive the painting.
To do so, tell us before the period ends with a clear statement, for example an email to [email protected]. You may use the form below, but you don't have to.
You must send the painting back within 14 calendar days of telling us, in the same condition and well packed. You pay the cost of returning it. Large paintings cannot normally be returned by ordinary post: a courier return costs roughly the same as the outbound shipping for that size and destination, shown on each painting’s page. You are liable for any loss in value caused by handling it beyond what is needed to examine it.
We will refund everything you paid, including the original delivery (at the standard rate), within 14 calendar days of being told of your withdrawal, using the same payment method. We may withhold the refund until we receive the painting or proof that you have sent it back.
Exception: commissioned paintings, made to your specifications, carry no right of withdrawal.
Withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)
To Ángeles Martínez Pomata, Cala Rajá, 1, 04118 Níjar (Almería, Spain), [email protected]:
I hereby give notice that I withdraw from my contract of sale of the following painting: [title of the painting].
Ordered on [date] / received on [date].
Name of consumer: [name]. Address of consumer: [address].
Signature (only if this form is sent on paper). Date.
9. Commissions
Size, timing and price are agreed in writing before work begins. A 30% deposit books your place; the balance is paid when the painting is finished and before it ships. The usual timeframe is 6 to 8 weeks, with progress photographs along the way. If you cancel once the painting has been started, the deposit is not refunded. The painting is made with the artist's own judgement and style.
10. Guarantee
If you buy as a consumer, you have the 3-year legal guarantee from delivery if the painting does not match its description or has a defect. It does not cover wear caused by unsuitable use or display (direct sun, damp, heat).
11. Copyright
You are buying the physical painting. The intellectual property rights, including reproduction rights, remain with the artist: the painting may not be reproduced, nor its image used commercially, without her written permission.
12. Complaints
Please write to us first at [email protected]: we reply within 10 working days. If you want to make an official complaint or claim, you can download the form of the Regional Government of Andalusia at www.consumoresponde.es and submit it at this address: Cala Rajá, 1, 04118 Níjar (Almería, Spain), or by email to [email protected]. You can also contact the consumer services where you live.
13. Governing law
These terms are governed by Spanish law. If you are a consumer, you keep the protection given by the law of your country of residence and may bring a claim before the courts where you live.
14. Personal data and changes
We handle purchase data as explained in the privacy policy. The terms in force on the day of purchase apply.
